Applicable law

This Agreement shall be governed by the law of England and courts of England and Wales will have exclusive jurisdiction in relation to these Terms of Use.

Vehicle Recovery And Transport Terms And Conditions

By placing a booking with us you are deemed to have fully accepted our terms and conditions. You must take all precautions for your own safety and that of any occupants of your broken down vehicle at all times. Easy Car Recovery shall not be liable for loss of or damage to any vehicle prior to loading and after discharge from the transporting vehicle, howsoever such loss or damage arises, except during handling of vehicles held by us. Easy Car Recovery does not accept any responsibility for the loss of or damage to the contents of any vehicle at any time, it is deemed that the customer has removed all valuable personal belongings and contents from the vehicle before the vehicle is loaded on to our truck or handed over to our driver. The confirmation of booking or our acceptance to transport a vehicle does not imply that the vehicle will actually be loaded. Actual loading and/or delivery will depend on any circumstance, which may prevent Easy Car Recovery from reaching the collection point or destination and actually loading / unloading the vehicle. We reserve the right to cancel or delay any shipment without penalty and / or liability.

Payment

A 20% non-refundable deposit is required to be paid prior to us dispatching the driver to your location. The remaining balance should be paid directly to the driver prior to unloading the vehicle. The deposit amount will be deducted from the total rate quoted. If Easy Car Recovery are instructed to collect a vehicle on or after any particular day/time, yet are unable to collect the vehicle due to the vehicle being unready at the collection point or funds being uncleared, or any other reason out of our control, then the contract shall be deemed terminated and Easy Car Recovery shall be entitled to claim full payment for the transportation order. Easy Car Recovery reserves the right to the charge the customer for any costs incurred by Easy Car Recovery during the transportation of your vehicle such as congestion charges, toll charges, ferry charges, low emission zone charges etc Our driver(s) will wait for a maximum of 30 minutes, if the driver is required to wait any longer, then a waiting charge shall be applied. The charge is currently £50.00 per hour for each driver. Drivers reserve the right to refuse the loading of a vehicle if it is considered by him/her unsafe to do so, for whatever reason, the driver has absolute discretion on the decision. During our period of responsibility which is whilst the vehicle is loaded on our truck, all vehicles are covered by our ‘Goods In Transit’ insurance, a copy of which is available on request. Whilst every effort is made to keep to promised delivery schedules, Easy Car Recovery will not be held responsible for late or failed collections or deliveries due to unforeseen circumstances beyond our control such as road works, traffic accidents, breakdowns or adverse weather conditions etc. Any damage not notified on the delivery note, will not be accepted by us, unless we are notified in writing within 48 hours of the delivery, and the damage can be viewed by us, prior to any repairs. Any damage notified to us on the delivery note, estimates must be submitted within 7 days and we reserve the right to claim any replaced part, as proof of damage. Easy Car Recovery will not be held responsible for any damage that cannot be attributable to negligence on behalf of Easy Car Recovery or their staff for example Acts of God (Storm damage, Bird Strike, Bird Droppings, etc.), stone chips, acts of vandalism not preventable by Easy Car Recovery. Easy Car Recovery will not provide or be liable to any hire cars, replacement vehicles or compensation whilst the vehicle is being repaired. We sometimes sub-contract the breakdown, recovery or towing job to vetted and insured third party companies within our recovery network. In the event of any claim or liability arising, we shall forward you details of the company responsible and liaise with you in rectifying any issues without accepting any financial liability on our part.

Cancellation and Refund Policy

Easy Car Recovery reserves the right to charge a call out charge of £89.99 at our discretion, or the full cost advised at the time of the booking for the specific booking once at location of the vehicle to be transported / recovered even if the customer decides not to have the vehicle transported or recovered. No refunds will be given for cancellations made less than 48 hours prior to the agreed transport date if a booking was made in advance. No refunds will be given after the vehicle has been transported. You will be charged the full amount of the quoted service price for any of the following cancellation instances/reasons: driver is on scene and you cancel for any reason; driver determines you have inaccurately stated the conditions of your vehicle thus the cost of service will be higher than initially quoted and you cancel service; you are Gone On Arrival and/or fail to cancel service. To the extent your description of the services needed and/or conditions impacting your vehicle are deficient, inaccurate or otherwise misstated and/or the services required are more extensive than your description indicated, the price quoted shall not be binding and you are responsible for paying for any additional services needed and/or requested. The provision of the services provided to you by a recovery network Provider is subject to any agreement that you choose to enter into with the recovery network Provider. Easy Car Recovery is never a party to any such agreement and you hereby agree to release Easy Car Recovery from all liability and claims arising from any acts or omissions of the recovery network Provider.

Monitoring of telephone calls and emails

Telephone calls or email correspondence made by you for our services or otherwise as a result of your access to the Site may be randomly recorded and monitored. By using such communication methods, you are consenting to such recording or monitoring.
